Snell Law is thrilled to share news of a significant win for our client in the Texas Third Court of Appeals regarding a complex civil conspiracy and defamation lawsuit. Spearheaded by attorney Lance Cawthon, our firm successfully appealed the trial court’s denial of our client’s motion to dismiss under the Texas Citizens Participation Act (TCPA).
Our client, a concerned parent deeply involved in the community, was targeted with a lawsuit by a former school-district election candidate. This action was a clear attempt to retaliate against our client for exercising their right to free speech and aimed to intimidate and silence their statements.
Snell Law argued before the appellate court that the plaintiff’s claims lacked legal basis and warranted dismissal under the TCPA. The appellate court agreed, reversing the trial court’s decision and sending the case back to the trial court to determine the attorney’s fees, costs, and sanctions owed to our client.
