Snell Law Prevails at the Third Court of Appeals

Snell Law obtained a win for its clients at the Third Court of Appeals in a business partnership dispute. 

Snell Law’s clients, an engineer and her engineering firm, filed suit against their former business partner for a variety of tortious acts and injunctive relief. The trial court initially granted a temporary restraining order and then an agreed temporary injunction. Snell Law’s clients moved to enforce the agreed temporary injunction while Defendants moved to compel arbitration. The trial court held Defendants in contempt and denied the motion to compel arbitration. Defendants sought an interlocutory appeal of the order denying the motion to compel arbitration.

The appellate court held no enforceable arbitration clause existed and that, even if an enforceable agreement to arbitrate did exist, Defendants waived any right to enforce said agreement by substantiality invoking the litigation process. The Third Court of Appeals concluded the trial court did not abuse its discretion by denying Defendants’ motion to compel arbitration.

Snell Law intends to aggressively pursue this matter now that it has been remanded to the trial court for further proceedings.
