On Friday, September 28, 2018, the Snell Law Firm obtained a jury verdict in favor of its client on all claims brought by Plaintiff. The week-long jury trial was before Judge Jan Soifer in the 345th Judicial District Court, Travis County, Texas. After Judge Jan Soifer entered a directed verdict the day before in favor of the Snell Law Firm’s client on all counts but one, the jury found in favor of the Snell Law Firm’s client on the sole, remaining fact issue.
The week-long jury trial related to a real estate transaction involving the purchase and sale of commercial real estate in Austin. the Snell Law Firm’s client is a Denver real estate investor—Lamar Gateway Investments Holdings, LLC—that sold Plaintiff land adjacent to its retail shopping center. The dispute centered on Baceline’s ability to restrict the building height on the land sold and whether the sale included the shopping center’s 35-foot pylon sign. The judge and jury reached their verdicts after hearing testimony from seven different witnesses, including multiple real estate professionals involved in the transaction. The judge and jury determined Baceline has the right to restrict Plaintiff’s building height and the pylon sign’s conveyance was the result of a mistake made by both parties in the conveyance documents.
After the trial, Jason Snell of the Snell Law Firm said, “This is a huge win for Baceline. Plaintiff’s claims potentially totaled more than $3 million, and these verdicts allow Baceline to hopefully return to business-as-usual without the interruption and distraction of this lawsuit. Skrabanek added, “We are delighted with this result for Baceline, which is an excellent company made up of excellent individuals.” A hearing on Baceline’s recovery of its attorney fees and expenses and for entry of final judgment has yet to be scheduled.
